All use of either the Debbie Kneale and Performance Cycling shops and websites and all purchases and bookings made via our websites, sales pages, or direct via email/phone/Whatsapp with our office are conditional upon acceptance of these Terms and Conditions.

We reserve the right to amend these Terms and Conditions from time to time without notice and at our discretion. Any such amendments shall come into effect immediately once posted, therefore it is your responsibility to periodically review this page. Your use of the Sites and Services will be deemed acceptance of any such amended Terms and Conditions.

The term “The Company" or “us” or “we” refers to the owner of the websites. The term “you” refers to the user, purchaser or viewer of our websites.

By continuing to browse, use and/or purchase from the Debbie Kneale or Performance Cycling websites you are agreeing to comply with and be bound by these Terms and Conditions and our associated Privacy Policy

 

Booking terms and conditions

  • Bookings are accepted only with agreed payment and upon acceptance of these terms and conditions.
  • Ensure the email you give during the booking and payment process remains current, because this is how we will contact you.
  • The Company reserves the right to decline any booking at it's discretion, without giving any reason.
  • If booking details and payment details are different, it may cause a delay in processing an online order.
  • If anyone booking has any health, medical issues or additional learning requirements, please contact to discuss in confidence PRIOR to booking, so we can ensure we best serve your needs.
  • The Company reserves the right to terminate any users access and future entitlement without notice or refund if it appears security or terms of use have been breached.
  • Deposit/part payments - To help you budget, we offer easy payment options, or deposit payments on some events. Where this is taken up, you agree to pay the full amount agreed, at the times agreed during booking, regardless of whether the event or content in the case of online events is accessed or completed. To get any free online bonus content included on live courses, balance payment needs to be paid at least 3 weeks before the live date booked. Deposits are non refundable.
  • Online course enrolment - When enrolled onto courses/services with an online login element, participants are responsible for keeping their personal login details private and their email up to date.
  • Each online registration is for a single user only.
  • Personal, private emails only are accepted for login, not group ones other people also have access to.
  • When given access to our online courses/services, you agree to be bound by Company restrictions and prohibitions of use in addition to the booking terms. These must be agreed to separately before access to the online learning centre content is granted.
  • If a student enrolled onto an online course wishes to transfer to a live course date, they may do so if there is space available upon payment of the usual live course fee.
  • Once enrolled, students are responsible for working within qualifying periods and deadlines as provided within the course.
  • Cancellations - Once the online portal area is accessed, the option to cancel ends and no refunds will be given.

  • For live events, booking reserves your place at the event and so are non refundable, though you may send someone else in your place, if the event is suitable for them. Please contact us to confirm if you wish to do this at least 24 hours before the live event is due to take place.

Performance Cycling Instructor Courses

  • If a student requires additional time to complete beyond the standard enrolment period for that course, an extension can be purchased. An extension can be for 1, or 2 months and the time is added to the end of current/last enrolment, not from the date of purchase. To qualify, an extension must be paid at least 5 days before the end of an existing enrolment and a maximum of 3 extensions are allowed per enrolment. Where an extension is required to complete, current criteria will apply where any aspect has changed between initial enrolment and extension. 
  • Where Essentials Plus (L1) and Pro (L2) courses are bought together, Pro enrolment starts once Essentials Plus is completed. If Essentials Plus is not completed, Pro Level is forfeited without refund.
  • Any bookings or fees paid outside qualifying periods will be refunded, minus a £30 administration fee.
  • On courses where there are assessments, payment does not guarantee certification. Certification is awarded on passing the assessment criteria for that course.
  • Assessments -  One marking and feedback of each assessment element is included in courses where applicable. If any student does not reach the required competencies to pass in any assessment element, they may retake/resubmit within 30 days of referral notification and upon payment of the appropriate resubmission fee. Online assessments must be completed within the enrolment period. If all assessment elements have not been passed within 6 months of live course attended, the course and all assessments would need to be repeated.
  • Certification - Once instructors pass the assessment elements for their course they receive ongoing annual certification, plus refreshers, marketing materials and more via their Instructor Support Package subscription. This is included free for the first year, after which there is a small fee to renew of £35 per year, paid via Direct Bank Transfer. (Also available in other currencies) Instructor rewards can be used for renewal where earned.
  • Renewal payments - Direct Debits for autorenewal are set up on passing, though first payment is not taken for 12 months (If Instructor rewards are earned in that year, they can be used instead to renew.) Instructors can cancel easily via their bank if no longer required and are responsible for doing so at least 5 working days before next payment is due. Where active direct debits are attempted and fail for any reason, a £2 fee is due in addition to the standard £35 fee, which will be added to the next payment attempt.
  • Renewal is at our discretion. From time to time and where significant changes have been made to content or criteria, a complimentary update will be provided to instructors to ensure they remain current. Any complimentary updates provided, must be completed within given timeframes in order to remain certified. Performance Cycling Instructors must identify themselves as such and not promote themselves under any other name or brand of indoor cycling, including Spin/Spinning unless they hold a relevant certificate for that brand.
  • Telephone coaching/viva's - Date and times for this service can be secured only upon receipt of payment. Once paid for, your specific time and date agreed will be confirmed by email. We must receive at least 24 hours notice of any change required by the client. Failing this, the fee and the time slot booked would be forfeited.
  • A minimum of £30 administration fee applies to any booking changes requested.

 

Corporate/ in house events from March 2020

Details/requirements of live events/courses/workshops booked for delivery 'in house' at a host venue are discussed and confirmed prior to booking.

Invoicing secures your event date and fees as agreed in your quote. In all cases, deposits are non-refundable.

In the event of cancellation of a confirmed booking by the host after the issue of invoice, cancellation fees will be charged as detailed below. Fees are based on the total value of the booking:

91-180 days (from date of event): 50%

31-90 days: 75%       

30 days or less: 100%

Cancellations must be confirmed to us in writing by email. We will acknowledge receipt of any cancellation requests within 2 working days of receipt.

 

Health and fitness notice

Our fitness events are designed for those of general good health and require a degree of fitness to complete any practical parts.
By booking this training you confirm it is safe for you to undertake exercise and you assume the risk and the responsibility for any injury, damage or loss resulting from your participation in any activities.
Online students are responsible for their own and participants safety whilst practicing the practical teaching to become an instructor.

 

Additional learning support

Where the need for additional support is identified, reasonable adjustments can be made for learners with particular requirements. Please contact in confidence BEFORE booking to discuss individual needs.

 

Order processing, dispatch and delivery times.

Office hours are 9am - 5.30pm (GMT) Monday to Friday. Closed public and bank holidays.

Orders received within these times are processed as below. Orders received outside office hours will be processed the next working day.

All orders are processed within 2 working days of payment.

Mp3's are available upon receipt of payment from your account area.

All other digital and online course products will be sent via email. Please ensure you check your junk box before contacting us if you have not received anything within 2 working days of payment.

Tangible product orders in stock are usually dispatched within 2 working days of receipt of payment.

Estimated delivery times for all products in stock are:

  • Within the UK - 4 - 5 working days.
  • Within EU - 5 - 10 working days.
  • Rest of the world - 10 - 15 working days.

*Where items are no longer available due to unprecedented demand, we will offer you a choice of refund or alternative product, to the value of the original purchase.

Please note - goods will be sent to addresses given during the payment process. Customers are responsible for making sure the address they provide is complete and correct. If you wish to make any change, you must notify us IMMEDIATELY after your purchase is completed from the same email address used and quoting your unique purchase transaction ID number.
Orders giving unconfirmed addresses may experience a delay in dispatch for security reasons.

For delivery address outside the UK, there may be import duties due once the parcel reaches its desitnation country. Any such charges must be paid by the recipient of the parcel. We have no control over any charges levied by customs and as policies vary by country, it is advised to check local customs for more info. prior to ordering.

 

Returns/Cancellations

We trust you will be delighted with your purchases from us and we honour all your statutory rights as a consumer. 

If any product is found to be damaged, faulty, or requiring return, please contact us with details within 7 days of receipt by completing our Product Return form and we will contact you direct within 3 working days. Do NOT post anything back to us before receiving a Return Number from us.

Any faulty goods will be replaced or refunded including any postage paid. Where a product is not faulty, return costs are the responsibility of the purchaser. 

We cannot accept liability for untracked returns, so we highly recommend using a tracked method of posting. 

Any clothing products returned must be returned unworn, unwashed and unused and with all tags still attached. 

Due to ease of copying CD's /DVD's once opened will not be refunded. Any CD or DVD found to be faulty and returned within 7 days of receipt would be replaced with the same title. Please note, some CD's may be packaged in solid plastic jewel cases. They leave here in perfect condition, but occasionally this type of case has been cracked during transit. Any such damage is cosmetic and does not affect the quality of the CD at all, if you wish to make a claim for postal damage, please contact Royal Mail.

For digital content, once downloading has begun, eligibility for a return or refund ceases. 

 

Corporate/ in house courses

Details/requirements of live courses/workshops booked for delivery 'in house' at a host venue are discussed and confirmed vie email prior to booking.

Cancellations/refunds for live freelance and corporate / in house events from March 2020

Your safety is paramount, and due to covid-19, we have made changes to the live course delivery to ensure your safety and covid security.

Part of this involves reduced numbers and blended learning. For live courses, payment now reserves your place at the live event and provides online learning access from the booking date, so all monies are non-refundable.

However, if you have to cancel attending the live date booked due to covid, you will be transferred free of charge to the equivalent online option and supported personally by Debbie to complete remotely.

The same would apply if we have to cancel a live date due to covid. We will always give as much notice as possible, but are aware local lockdowns can happen at any time, sometimes with very short notice.

For any scenario, we will not be liable for any other costs incurred, including any travel or accommodation charges you may have already paid.

 

Copyright notice

The copyright and other intellectual property rights in all material and content on the Site and online learning content (including, without limitation, text, images, web pages, sound, software (including code, interface and website structure), video, photographs and graphical images, and the look and feel, design and compilation thereof) are owned by the Company or its licensors.

All rights are reserved and any copying, redistribution or reproduction of part or all of the contents in any form is expressly prohibited.

You may not distribute or commercially exploit the content of our web content or our online learning content, or use any part, adapted or whole as a base for derivative works. Nor may you transmit it or store it in whole or part in any form, web, electronic or printed.

For the avoidance of doubt, you understand and agree that you are permitted to use any online or hard copy content/material only as set out in these Terms and Conditions or as otherwise expressly authorised in writing by the Company or its licensors.

Those studying online with us will also be bound be additional Terms, specific to the online courses and content. These will be made available to you separately, if you have booked an online course.

All trademarks reproduced in this website, which are not the property of, or licensed to the operator, are acknowledged on the website.

The Company will own all written/photographic/video taken or submitted by you to the site or tutors and may use it for any commercial and/or non-commercial purposes without seeking further permission or providing remuneration.

 

Restrictions and prohibited use

You are expressly prohibited from copying, reproducing, transmitting, publicly performing, distributing, adapting, commercially exploiting, translating, modifying, bundling, merging, sharing, or using any of our website or learning courses content/material or services in part, whole or as inspiration for creating any similar products, courses or services. 

 

Service access

While the Company endeavours to ensure that the Sites are normally available 24 hours a day, the Company will not be liable if for any reason the Sites are unavailable at any time or for any period.

Access to the Sites may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond the Company’s control.

 

Visitor material and conduct

Other than personally identifiable information, which is covered under the Privacy Policy, any material you transmit or post to the Sites will be considered non-confidential and non-proprietary.
The Company will have no obligations with respect to such material. The Company and its designees will be free to copy, disclose, distribute, incorporate and otherwise use such material and all data, images, sounds, text and other things embodied therein for any and all commercial or non-commercial purposes.

You are prohibited from posting or transmitting to or from the Sites any material:
(a) that is threatening, defamatory, obscene, indecent, seditious, offensive, pornographic, abusive, liable to incite racial hatred, discriminatory, menacing, scandalous, inflammatory, blasphemous, in breach of confidence, in breach of privacy or which may cause annoyance or inconvenience;
(b) for which you have not obtained all necessary licences and/or approvals;

You may not misuse the Sites (including, without limitation, by hacking it).

The Company will fully cooperate with any law enforcement authorities or court order requesting or directing the Company to disclose the identity or locate anyone posting any material in breach of this section.

If your use of material on the Sites results in the need for servicing, repair or correction of equipment, software or data, you assume all costs thereof.

 

Links to and from other websites

Any links to third party websites on the Sites are provided solely for your convenience. If you use these links, you leave the Sites. The Company does not control and is not responsible for these websites or their content. The Company therefore does not endorse or make any representations about them, or any material found there, or any results that may be obtained from using them and use is at your own risk.

Occasionally, when we find products or services particularly useful ourselves, we may promote them as an affiliate. We may receive affiliate commissons from those products without any additional cost to you.

Electronic communication

When you visit the Sites or send emails to the Company (for example, emails to Customer Service) via the Site, you are communicating with the Company electronically. The Company may communicate with you by email or by posting notices on the Sites. For contractual purposes, you consent to receive communications from us electronically and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. This paragraph does not affect your statutory rights.

 

Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with English law. Disputes arising in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the English courts.

These Terms and Conditions, including the Privacy Policy, constitute the entire agreement between you and the Company in relation to its subject matter and supersede any and all prior promises, representations, agreements, statements and understandings whatsoever.
The failure by the Company to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision.
If any provision of the Terms and Conditions is found by a court of competent jurisdiction to be unenforceable or invalid, you and the Company nevertheless agree that the court should endeavour to give effect to the intentions reflected in the provision, and the other provisions of the Terms and Conditions shall remain in full force and effect.

 

Disclaimer

While the Company endeavours to ensure that all information and content on the Sites is correct, up to date and free of virus or other malicious code, in no event will we be liable for any loss or damage including direct, indirect or consequential loss or damage, or any loss or damage arising from access, use of information, loss of data or profits arising out of, or in connection with, the use of our Sites and, or content therein.
